1. Acceptance of Terms

2. Description of Services

Rexburg Concrete Company provides concrete contracting services, including but not limited to concrete driveways, patios, sidewalks, garage floors, foundations, retaining walls, steps, pool decks, parking lots, footings, and related concrete work. Our services are provided in Rexburg, ID and surrounding eastern Idaho communities.

All services are subject to availability, site conditions, weather, and agreement on scope and pricing before work begins. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

Any estimate or quote we provide is based on information available at the time of the assessment and reflects expected scope, materials, and labor. Estimates are not guarantees of final cost. Final pricing may vary if:

• Site conditions differ materially from what was observed during the estimate.
• The scope of work changes at the customer's request after an estimate is accepted.
• Unforeseen subsurface conditions, utility conflicts, or access issues are discovered during the project.
• Material prices change significantly between the estimate date and project start date.

We will communicate any changes to pricing before performing additional work that falls outside the agreed scope. Work does not begin until both parties have agreed on scope and pricing in writing.

4. Scheduling and Cancellation

Project start dates are scheduled based on crew availability and weather conditions. Concrete work cannot be safely performed in freezing temperatures, and we reserve the right to reschedule any project due to weather without penalty.

If you need to cancel or reschedule a confirmed project, please notify us as soon as possible. Cancellations made after materials have been ordered or work has begun may be subject to charges for materials already purchased and labor already performed. We will communicate any applicable charges clearly before they are applied.

We reserve the right to cancel or reschedule a project at any time due to crew unavailability, unsafe site conditions, or other circumstances outside our control. In such cases, we will notify you promptly and work with you to find a suitable alternative date.

5. Payment Terms

Payment terms will be specified in the written agreement or invoice provided before or upon project completion. Unless otherwise agreed in writing:

• A deposit may be required before work begins, particularly for larger projects or projects requiring material pre-orders.
• Final payment is due upon project completion unless other terms have been agreed to in writing.
• Accepted payment methods will be communicated at the time of your estimate or contract.

Past-due balances may be subject to interest and collection costs. We reserve the right to place a mechanics lien on the property in accordance with Idaho law if payment is not received.

6. Warranty Disclaimers

We stand behind the quality of our workmanship. If a defect attributable to our installation is identified within a reasonable period after project completion, contact us and we will assess the issue and work to address it.

However, concrete is a natural material subject to cracking, surface variations, and changes over time - particularly in climates like Rexburg's with significant freeze-thaw cycles. The following are not covered by any warranty:

• Hairline cracks, surface crazing, or color variations that are normal characteristics of concrete.
• Damage caused by misuse, excessive loads beyond design specifications, chemical applications (such as ice-melt products), or third-party modifications.
• Damage resulting from site conditions outside our control, including ground movement, drainage failures not caused by our work, or tree root intrusion.
• Work performed by us at the express direction of the customer in a manner we advised against in writing.

Our website and any information published on it are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

7. Limitation of Liability

To the fullest extent permitted by law, Rexburg Concrete Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to a specific project shall not exceed the total amount paid by you to us for that project.

8. Customer Responsibilities

To allow us to perform our work safely and effectively, you agree to:

• Provide accurate information about the project site and any known site conditions, underground utilities, or property boundaries.
• Ensure the work area is clear of vehicles, equipment, and obstructions before the crew arrives.
• Notify us of any HOA, city, or county restrictions that may apply to the project before work begins.
• Call 811 (Dig Safe) to have underground utilities marked, or confirm that this has been done, before excavation begins.

We are not responsible for delays or damage resulting from inaccurate information provided by the customer or from obstructions or site conditions the customer failed to disclose.

9. Dispute Resolution

We prefer to resolve any dispute directly and informally. If you have a concern about a project or an invoice, please contact us first at info@rexburgconcretecompany.com and give us the opportunity to address it.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any legal action. Any legal proceedings that cannot be resolved through mediation shall be brought exclusively in the state or federal courts located in Madison County, Idaho, and both parties consent to personal jurisdiction in those courts.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Idaho.

11. Intellectual Property

All content on our website - including text, images, logos, and design - is owned by or licensed to Rexburg Concrete Company and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.
